Am I greedy or lazy for seeking an increase in child support after 10 years?

My ex called me greedy for initiating a child support modification (the first and only) in a decade. He told me to get a better job so I wouldn’t need his money. How should I respond?

I’d respond by pursuing the child support modification without rising to his bait. He doesn’t really mean what he says when he calls or implies that you are greedy and/or lazy. He’s just upset that he’ll have to pay more child support.

You’re well within reasonable action by seeking an upward modification of child support after 10 years. If for no other reason, a modification is warranted just to have child support keep pace with the inflationary rise in the cost of living over the last ten years. Courts in my jurisdiction (Utah) recognize this kind of request as something your entitled to seek by right (entitled to seek, not necessarily entitled to automatically get). See Utah Code §78B-12–210(8).

Claims that you are greedy or lazy are pretty lame defenses to a motion to increase child support after 10 years. As long as you are not unemployed or underemployed, your chances of prevailing on your motion to modify child support are good.
