A house does not need to be vacant to be appraised and evaluated. The appraiser(s) can inspect and evaluate the house while you’re spouse or ex-spouse is still living there without any real trouble.
If your question is based on a scenario in which your spouse will not allow the appraiser(s) on to the property and inside the house for the purpose of inspecting it in the appraisal process, you can go to court to request an order for an appraisal and for your spouse to cooperate fully in the appraisal process. That way, if your spouse does not obey the court’s order, he or she can be held in contempt of court and sanctioned for contempt by being fined and or jailed for non-compliance.
