How Do You Fight an Attorney Who Keeps Asking for and Obtaining Continuances in a Family Court Case?

An unscrupulous opposing party and his/her attorney can find many benefits to delaying the progress of a pending court case, so it comes as no surprise if and when you encounter such an opposing party and/or opposing counsel.

If you have the goods on the opposing party’s shenanigans and can provide proof of this to the court (as opposed to pinning your hopes on a “trust me, Your Honor, the opposing party is up to no good, and even though I can’t prove it, take my word for it”), then you can (and should) bring the matter and the proof to the court’s attention and ask for the court to put its foot down to bring such misconduct to an swift end.

Don’t be surprised when the courts grant many continuances. It’s S.O.P. in most jurisdictions. It’s a product of courts being overworked and jaded, and I believe that many overworked, jaded judges and domestic relations commissioners leverage the slowly-turning wheels of justice to bring litigants to settle their cases and thereby extricate themselves from such a slow, frustrating, unjust justice system.

So stay vigilant, stay classy to get a case to progress as it should (or as close to progressing as it should as one can realistically expect in the real world).
