Schools are being asked to provide services that have nothing to do with schooling, and many school therapists are going well beyond the bounds of fostering a child’s education.
“Ah, but what about the ‘vital’ role school therapists play in identifying and reporting child abuse?,” some may ask. H.B. 281 does not prohibit a therapist from exploring that. H.B. 281 would provide that notwithstanding requirements to obtain parental consent before a therapist may discuss certain topics with a student, if a student reports information that creates a duty on the school-based mental health therapist to make a report for the following, the therapist may discuss the information with the student to the extent necessary to make the mandatory report for:
(A) suspected cases of child abuse or neglect under Utah Code Section 80-2-602;
(B) abuse of a student under Utah Code Section 53E-6-701; or
(C) any other legally mandated duty to report an incident.
