Unless the law of your jurisdiction or a court order in your particular case prohibits your children from viewing or posting on social media during the pendency of the divorce action, they are free to view social media posts and to post on social media. You will, however, 1) want to ensure whether there is any law(s) or court order(s) that place(s) restrictions on you your as to what they can view or post on social media; and 2) instruct your children not to post anything that would violate the law or that would cast their other parent or you or the children in a negative light. Even if there are no statutes or court orders that place any restrictions on the children’s use of social media, ensure that they use social media responsibly. This is true of whether you’re in the middle or a divorce case or not.
